A judge has upheld the Dickinson County Commission’s 2-1 vote to let it proceed with construction of the Hope Ridge wind farm. Several residents who oppose the construction of the Hope Ridge Wind Farm had filed a civil lawsuit against the Dickinson County Board of County Commissioners. Listed as plaintiffs were Steve Johnson, Sherry Johnson, Robert D. Hoffman, Jr., Kay Hoffman, Marla Reiff, Dan Reiff, Russell Brehm, Patricia Brehm, William Jackson and Amy Jackson. In his ruling, Fifth District Judge Lee Fowler concluded that none of the alleged errors raised by the plaintiff’s merited reversal or remand of the Commission’s decision to approve the Conditional Use Permit requested by Enel Wind Energy. In February, the case was moved to the Fifth District and Judge Fowler was appointed after the judges of the Eighth District had all recused themselves.
